VIOLATION GUIDANCE

NYC building violations:
understand the next steps.

An open building violation can involve more than paying a fine. The next steps depend on who issued it, the condition cited and whether correction requires professional review, plans, filings or physical work.

South Bedford Consulting helps owners and managing agents organize the records, coordinate the appropriate professionals and track the agreed corrective process.

Start with the notice and the issuing agency

A DOB violation, a DOB-issued OATH summons and an HPD violation do not follow the same process. Start with the notice, the property address, the violation or summons number and any stated deadlines.

DOB violations

The condition generally needs to be corrected, with proof provided to the responsible DOB unit. Applicable civil penalties may also need to be addressed. The requirements depend on the particular violation.

DOB-issued OATH/ECB summonses

For a DOB-issued summons, correcting the condition and addressing the OATH response or hearing are distinct parts of the process. Where certification is required, the Certificate of Correction is submitted through DOB NOW: Safety for review by DOB’s Administrative Enforcement Unit. Paying a penalty alone does not necessarily close the record. Other agencies’ OATH summonses follow their own correction requirements.

HPD violations

HPD notices set out correction and certification requirements. The notice’s deadlines and instructions matter. If correction was not certified on time, or certification was rejected, a dismissal request and reinspection may be required. Some conditions have additional requirements.

Other agency notices

For an FDNY, DEP, DOT or other agency notice, the issuing agency’s procedure must be checked. The first step is identifying the right process and the professionals needed, rather than assuming one correction route applies to every notice.

How SBC can help

Our involvement is defined around the property, the open items and the support you need. It can include:

  • Gathering available notices, drawings, permits and related correspondence.
  • Preparing an open-item summary and identifying missing information.
  • Coordinating review by the appropriate design, filing or other professionals.
  • Organizing the agreed next steps, responsibilities and dependencies.
  • Following up on documentation and reporting the status of outstanding items.

Technical evaluations, designs, certifications and regulated submissions remain the responsibility of the appropriately qualified professionals. Corrective construction is separately scoped and contracted. Legal advice and hearing representation require the appropriate legal support. The issuing agency determines acceptance and closure.

What to send us

Start with the property address and a short description of the issue. If available, include the violation or summons number, issuing agency, notice date, hearing or filing deadline, and the status of any work already completed. Let us know whether an architect, engineer, filing representative, contractor or attorney is already involved.

You do not need to have every document ready to make an inquiry. Our office can identify what additional information is needed before the engagement is scoped.

COMMON QUESTIONS

Clear roles and next steps.

I paid the penalty. Why is the violation still open?

Payment and proof of correction can be separate requirements. For DOB-issued summonses, an open record may still require acceptable correction documentation unless it has been dismissed. Check the actual notice and current agency record. See DOB’s summons and violation guidance.

Do you carry out the repairs?

SBC provides advisory and coordination services. Where physical repairs are needed, the construction scope and contractor engagement are handled separately.

Can you work with my existing professionals?

Yes. The engagement can be organized around your existing team, with responsibilities and any additional professional input identified at the outset.

Can you guarantee removal or a completion date?

No. The work required, available records, professional reviews and agency decisions affect the process. SBC’s role is to organize and coordinate the agreed steps, not guarantee an agency outcome.

Discuss a violation

The intake is not an emergency service and submitting it does not preserve a hearing or filing deadline. Follow the notice’s instructions and obtain appropriate professional advice for urgent matters. Services and responsibilities are confirmed through an agreed engagement.
